ADAM Terms of Use

These terms apply to the ADAM app and the website adamlifestyle.com, provided by ADAM Lifestyle, managed by Niko Toluono in New Zealand ("we", "us"). By downloading or using ADAM you agree to them. If you don't agree, please don't use ADAM.
1. Health and safety: please read
ADAM is a fitness tool, not medical advice. Its timers, training and nutrition guidance are general information and are not a substitute for advice from a doctor or other qualified professional. Check with your doctor before starting a new exercise or diet programme, especially if you are pregnant, have a medical condition or injury, take medication, or haven't exercised for a while. Stop exercising and get medical help if you feel pain, dizziness, faintness or shortness of breath. Heart-rate and distance figures can be inaccurate and must not be used for medical purposes. You exercise at your own risk.
2. Who can use ADAM
Anyone may use ADAM's timers. To create an account you must be at least 13 (or the minimum age in your country), and to save a health profile you must be at least 16. If you are under 18, please use ADAM with the permission of a parent or guardian.
3. Your account
Keep your sign-in details safe and tell us at [email protected] if you think someone else has used your account. You're responsible for activity on your account. You can delete your account at any time in the app (Settings → Account → Delete account).
4. Your content
Timers, profiles, runs and other information you add remain yours. You give us permission to store, copy and process them only as needed to provide ADAM to you, for example to sync them between your devices. How we handle personal information is explained in our privacy policy.
5. Acceptable use
Please don't misuse ADAM. In particular, don't try to access other people's accounts or data, disrupt or overload our servers, reverse engineer the app except where the law allows, use automated means to create accounts or access the service, or use ADAM for anything unlawful. We may suspend or close accounts that break these terms.
6. Ads and future purchases
ADAM is free to download and shows ads. We may offer optional paid features in the future; if we do, their price and terms will be shown before you buy, and payments will be handled by the App Store or Google Play under their terms.
7. Licence
We give you a personal, non-exclusive, non-transferable licence to use ADAM on devices you own or control, under these terms and the rules of the store you got it from. ADAM, its name, logo, design and content belong to us and our licensors.
8. Changes and availability
We keep improving ADAM and may add, change or remove features. We aim to keep the service running but can't promise it will always be available or error-free. We may update these terms; if the changes are important we'll tell you in the app before they apply. Continuing to use ADAM after that means you accept the new terms.
9. Disclaimers and liability
ADAM is provided "as is" and "as available". To the extent the law allows, we make no promises about its accuracy, reliability or fitness for a particular purpose, and we are not liable for any indirect or consequential loss, or for any injury or loss arising from exercise or diet choices you make. Nothing in these terms limits rights you have under consumer law that can't be excluded, or our liability for death or personal injury caused by our negligence or for fraud.
10. Apple and Google
These terms are between you and us, not Apple or Google. Apple and Google are not responsible for ADAM or its support. If you downloaded ADAM from the App Store, Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Apple's standard licence terms also apply where these terms don't cover something.
11. Law
These terms are governed by the laws of New Zealand, without affecting any mandatory consumer protections of the country you live in. You may bring a claim in your local courts.
